TERMS AND CONDITIONS OF USE - IMEDIACENTER

SUBJECT

These general conditions of use (the "GCU") govern access to, browsing of and use of the website www.imediacenter.fr(link is external) or www.imediacenter.com (the "Site") by any user who is a natural person of legal age and legally capable of entering into a contract, acting principally in the course of his or her professional activity (the "User").

The site and these GTU are published by IMEDIACENTER ("IMEDIACENTER"), a simplified joint stock company, whose registered office is located at 243 - 245 rue Jean Jaurés 59650 Villeneuve d'Ascq, registered under number 808 615 926 at the R.C.S. of LILLE METROPOLE.

PERSONAL DATA AND COOKIES

Collection and processing of personal data

Personal data collected on the Site will be processed electronically. 

IMEDIACENTER, the Data Controller, undertakes to ensure that the processing of personal data complies with the French Data Protection Act of January 6, 1978, as amended by Law No. 2018-493 of June 20, 2018, and with the General Data Protection Regulation of April 27, 2016. 

This data may or may not be processed automatically by IMEDIACENTER, and is intended for use by IMEDIACENTER and its subcontractors, in particular for hosting purposes. It may be transmitted to partners with the express consent of the User. This data may also be transmitted to the competent public authorities, within the framework of the data controller's legal obligations. If the nature of the processing justifies a transfer outside the EU, this will be carried out in accordance with the regulations in force.

Personal data will be kept for 3 years from the last contact. It may be kept, anonymized, beyond this period for statistical purposes.

Purpose of processing

Data is collected for the following purposes:

- statistical analyses and studies, in particular to get to know the User better

- collecting user feedback on marketed services

- professional solicitation

- distribution of the IMEDIACENTER newsletter

- IMEDIACENTER corporate communications

The User's rights

The processing of your data is based on your consent.

By browsing the Site, the User acknowledges having read, accepted and fully and unreservedly complied with these GCU. Any use of the Site that does not comply with these GCU is prohibited.

IMEDIACENTER reserves the right to modify the GCU at any time, in whole or in part, in order to develop its operations and/or to respond to changes in the laws and regulations applicable to the Services or to the Company's activities. It is understood that the applicable GCU are those in force at the time of use of the site. In this respect, we invite the User to take note of the GCU each time he/she browses the Site.

The Company reserves the right to suspend or terminate, at any time, the use of the Site, in the event of a breach by the User of these GCU.

SITE CONTENT

The main purpose of the site is to present IMEDIACENTER's commercial offers (the "Services"). As such, the site formalizes the various communication channels and media offered at physical and digital points of sale. 

The site also features IMEDIACENTER's corporate communications and illustrations of recent customer operations.

The User may subscribe to the Site's newsletter by completing the relevant form on the Site, in order to receive information and offers from IMEDIACENTER. In order to validate your registration, you must accurately complete all mandatory fields of the registration form marked with an asterisk (*). Only one account per User is authorized, and any attempt at fraud may result in cancellation of the account. The account may also be terminated at any time and without notice for fraudulent or illicit use of the Site's services and content. You may unsubscribe from the newsletter at any time by clicking on the "unsubscribe" link in any e-mail sent to you.

Finally, the site provides access to IMEDIACENTER's official social networking pages.

The content presented is subject to change at any time and does not constitute a contractual offer.

INTELLECTUAL PROPERTY

All elements of the Site (in particular the architecture and graphic charter of the Site, as well as the trademarks, logos, graphics, drawings, photographs, animations, videos, and texts contained on the Site, as well as the computer codes of the elements composing it, and any downloadable document) are protected by copyright and/or other intellectual property rights and/or related rights such as the right of the producer of databases.

The User is prohibited from extracting, exploiting, copying, reproducing, representing, reusing, modifying or adapting, in any way and on any medium whatsoever, all or part of the content of the Site, without the prior and express authorization of the holders of the intellectual property rights concerned.

Access to the Site does not constitute recognition of any intellectual property right or neighbouring right in favour of the User.

Any use of all or part of the elements of the Site, in contradiction with the provisions of the present article is likely to give rise to legal proceedings, in particular on the basis of counterfeiting.

IMEDIACENTER LIABILITY

In any event, IMEDIACENTER may only be held liable for acts directly attributable to it in its capacity as publisher of the Site.

Without prejudice to any mandatory legal provisions to the contrary, the information communicated on the Site is provided for information purposes only and does not engage the responsibility of the Publisher, including in the event of any damage whatsoever resulting from its interpretation and/or use; this information may be modified, updated or deleted by IMEDIACENTER at any time and without prior notice.

The information and documents posted directly on the Site by IMEDIACENTER are considered reliable. However, they may contain technical inaccuracies and/or typographical errors, which IMEDIACENTER reserves the right to correct as soon as it becomes aware of them.

IMEDIACENTER undertakes to ensure the proper functioning of the Site. In principle, the Site is accessible 24 hours a day, 7 days a week. However, IMEDIACENTER does not guarantee that the Site and/or the functionalities it offers will function without interruption, breakdown or failure, and declines all responsibility, particularly in the following cases, without this list being limitative:

In the event of interruption of the Site for technical maintenance or updating of published information ;

In the event of temporary impossibility of access to the Site (and/or related websites and applications) due to technical problems, whatever their origin and source;

In the event of force majeure as defined by the jurisprudence of the French courts, including the interruption, suspension, reduction or disruption of electricity or other supplies, or any interruption of electronic communications networks, or in the event of events beyond its control.

USER LIABILITY

Access to and use of the Site are at the User's own risk. The User is solely responsible for any information communicated directly or indirectly via the Site.

In the event of abnormal use or illicit exploitation of the Site, the User shall be solely liable for any damage caused to third parties and for the consequences of any claims or actions that may arise therefrom.

The User also waives the right to take any action against IMEDIACENTER in the event of legal proceedings brought against him/her by a third party as a result of the illicit use and/or exploitation of the Site.

In general, the User undertakes to comply with all regulations in force in France.

INTEGRALITY - PARTIAL INVALIDITY

These Terms of Use represent the entire agreement between the Site User and the Publisher.

The invalidity or inapplicability of any of the stipulations of the Legal Notice and General Terms of Use shall not invalidate the other stipulations, which shall retain their full force and scope.

The terms declared non-existent would then be replaced by the terms that most closely resemble the content and meaning of the cancelled clause.

APPLICABLE LAW - JURISDICTION

These GCU are governed by French law.

In the event of a dispute or claim, the User is advised to contact the IMEDIACENTER Communications Department in order to seek and find an amicable solution.

Failing amicable settlement, the dispute will be submitted to the French Courts.
